1. Scope of Application

These General Terms and Conditions (GTC) apply to all deliveries from the online shop Nationales Automuseum The Loh Collection, operated by Stiftung Nationales Automuseum The Loh Collection gGmbH, Hauptstraße 154, 35716 Dietzhölztal (hereinafter: Online Shop), to consumers (§13 BGB – German Civil Code).

3. Offer and Conclusion of Contract

3.1 The presentation of products in the online shop does not constitute a legally binding offer but a non-binding invitation to place an order. All offers are valid “while supplies last,” unless otherwise noted in the product details. Errors excepted.

3.2 By clicking the “Place a binding order” button at the end of the ordering process, you place a binding order for the products in your shopping cart. The purchase contract is concluded when we accept your order by sending an order confirmation via email immediately upon receipt of your order.

4. RIGHT OF WITHDRAWAL

If the customer is a consumer, they have the right to withdraw from the contract in accordance with the following withdrawal instructions:

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you who is not the carrier, takes possession of the goods.

You may use the attached sample withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient to send the notice of the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you, including the delivery costs (except for any additional costs arising if you chose a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal.

We will use the same means of payment that you used in the original transaction unless explicitly agreed otherwise with you. In no case will you be charged any fees for this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is earlier.

You must send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of the withdrawal. The deadline is met if you dispatch the goods before the period of fourteen days has expired. You shall bear the direct cost of returning the goods.

Any loss in value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods shall be borne by you.

Exclusion of the Right of Withdrawal:

The right of withdrawal does not apply to contracts for the delivery of audio or video recordings or computer software in sealed packaging, if the seal has been removed after delivery.

5. Prices and Shipping Costs

5.1 The prices stated on the product pages include statutory VAT and other price components.

5.2 In addition to the stated product prices, shipping costs will be charged for deliveries within Germany. The shipping costs vary due to different product weights and will be clearly communicated to you again on the product pages, in the shopping cart, and on the order page. During the ordering process, you can use the “Shipping Cost Calculator” to check the current shipping costs for the items in your cart at any time.

6. Delivery

Delivery time is approximately 3 working days. Any differing delivery times will be indicated on the respective product page.

7. Payment

7.1 Payment can be made in advance (bank transfer), via PayPal, or by credit card.

7.2 If you choose payment in advance, we will provide our bank details in the order confirmation, and the goods will be shipped after receipt of payment.

7.3 You are only entitled to offset claims if your counterclaims have been legally established by a court or recognized by us in writing.

7.4 You may only exercise a right of retention if the claims result from the same contractual relationship.

8. Retention of Title

The goods remain our property until full payment has been made.

9. Warranty

Warranty is provided in accordance with statutory provisions.

10. Storage of Contract Text

The contract text is stored in our internal systems. You can view the General Terms and Conditions at any time on this page. The order data and GTC will be sent to you via email. After the order process is completed, the contract text will no longer be accessible online for security reasons.

The order and contract language is German.
